$100m Fraud: Trial of Ibrahim Mahmud Resumes April 20

Justice Yusuf Halilu of the Federal Capital Territory High Court, Maitama Abuja has fixed April 20, 2021 for definite hearing of the six count charge of forgery and attempt to obtain $100,000,000 USD brought against Ibrahim Olanrewaju Mahmud by the Economic and Financial Crimes Commission, EFCC. The offence contravenes Sections 6 and 8 of the Advance Fee Fraud and Other Fraud Related Offences Act 2006 and Section 362, 366, and 364 of Panel Code.

The defendant who is Group Managing Director of Triumph Oil and Gas Madagascar Nigeria Limited, an unregistered company, allegedly presented forged documents to the Central Bank of Nigeria seeking payment of $50,000,000 USD for a purported $100,000,000 contract for monitoring and supervision of major Federal Republic of Nigeria infrastructure projects, approved to his company by the apex bank.

Other  forged documents recovered from the defendant include a letter purportedly emanating from the Ministry of Petroleum Resources signed by  the Minister of State, Chief Timipre Sylva; another document from the Presidency supposedly signed by Sabiu Yusuf, Special Assistant to the President; certificates of payments in millions of Dollars, purportedly signed by President Muhammadu Buhari and contract award letters, signed by Godwin Emefiele Governor of Central Bank, CBN.

One of the counts reads; “That you, Ibrahim Olanrewaju Mahmud, on or about 22nd July,2020, in Abuja within the jurisdiction of the High Court of Federal Capital Territory, while acting as the Group Managing Director, Triumph Oil and Gas Madagascar Nigeria Limited, a Company not registered with the Corporate Affairs Commission and with intent to defraud, did attempt to obtain the sum of $50,000,000.00(Fifty Million US Dollars) only from Central Bank of Nigeria, under the false pretense that Triumph Oil & Gas Madagascar Nigeria Limited is responsible for monitoring and supervision of major Federal Republic of Nigeria infrastructure projects, forfeited assets and government businesses, that the said sum represent a contract payment approved by the central bank of Nigeria which you knew to be false and thereby committed an offence contrary to Section 8(b) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006 and Punishable under section 1(3) of the same Act”.

Another count reads; “That you, Ibrahim Olarenwaju Mahmud on or about 8th May, 2020 at Abuja, within the jurisdiction of the High Court of the Federal Capital Territory, fraudulently made false document to wit; Central Bank of Nigeria Certificate of Ownership dated 8th May, 2020, purportedly signed by Mr. Godwin Emefele, Governor of Central Bank of Nigeria an National Assembly of Federal Republic of Nigeria Signature stating that you are the rightful beneficiary of US$ 100,000,000.00( One Hundred Million Dollar USD) only with the intention of causing same to be believed that the said document was genuine and emanated from Central Bank of Nigeria, which you knew to be false and thereby committed an offence contrary to Section 362 and Punishable under Section 364 of the Panel Code Cap. 532 Laws of the Federation of Nigeria, (Abuja) 1990”.

He pleaded “not guilty” when the charges were read to him.

Justice Halilu granted the defendant bail on the condition that he provides two sureties who must be residents of Wuse, Garki, Maitama or Asokoro in Abuja. The sureties must deposit their title document with the Court and their addresses verified by the Court.

The two sureties must also undertake to produce the defendant to the Court and if they fail to do so, forfeit their houses to the Federal Government.

The defendant is to also deposit his travel document with the court.

Man Docked for Alleged N17.4m, $6,300 Fraud

The Economic and Financial Crimes Commission, EFCC, Lagos Zonal Office, on Monday, March 22, 2021, arraigned one Nanpan Salihu Yaniyang before Justice O.O. Abike-Fadipe of the Lagos State High Court sitting in Ikeja , Lagos  on a four-count charge bordering on stealing and obtaining by false pretence to the tune of N17,449,000 ( Seventeen Million Four Hundred and Forty-nine Thousand Naira) and $6,300( Six Thousand Three Hundred United States Dollars).

One of the counts reads: “Nanpan Salihu Yaniyang , sometime in 2020 in Lagos State , within the jurisdiction of this Honourable Court, with intent to defraud, obtained the sum of N17,449,000 (Seventeen Million Four Hundred and Forty-nine Thousand Naira) from Valerie Okoli and her co-investors under the pretence that you would help them incorporate a company, and use the said fund to invest in Forex, which pretext you knew or ought to know is false.”

Another count reads:  “Nanpan Salihu, sometime in 2020 in Lagos State, within the jurisdiction of this Honourable Court, with intent to defraud, obtained the sum of $6,300 (Six Thousand Three Hundred United States Dollars) from Valerie Okoli and her co-investors under the pretence that you will use the said fund to invest in Forex, which pretext you knew or ought to know is false.”

He pleaded not guilty to the charges brought against him.

The prosecuting counsel, Ayanfe Ogunsina , asked the Court for a trial date and, remand the defendant in custody.

The defence counsel, Cyril Ebeh, informed the Court that he had filed an application for the bail of the defendant.

Consequently, Justice Abike-Fadipe adjourned till March 29, 2021 for hearing of the bail application and ordered that the defendant be remanded at any of the Correctional Centres in Lagos.

‘Non-State Actors’ And Nigeria’s Warped Educational Trajectory

All of us will be deceiving ourselves, collectively, as a people, if we claim not to know that the Nigerian formal system of education had long been in jeopardy and currently in the phase of progressive steep decline. If there are people still in doubt about this, some facts will be advanced, soon, for clarity. This sad reality is, particularly, clearly evident at all levels of publicly owned educational facilities. It is no more news that these earlier mentioned public facilities are merely struggling – with positive hopes and aspirations against many odds, to deliver high quality human capital, and other products. The painful decline in quality of inputs into, and outputs from, public educational facilities resulted mainly from multifarious but intertwined human-induced causes such as low self esteem of many past and current government officials, somersaults in governments’ educational and allied policies and the quest(s) for immoral, and most times illegal, acquisition and/or conversion into private property, of public wealth, by those that were/are expected to make them productive for common good. This list is almost endless.

This decline, that has gradually become a decay, deliberately, set in motion by successive governments with consistent negative advice and encouragement from local and foreign evil collaborators – has been the kernel of almost all the reasons for the avoidable intractable struggles by Academic Staff Union of Universities (ASUU) over the years. These struggles were necessitated by ASUU’s resolve to resist the attempts, by individual(s) or group(s), at completely destroying public universities the way public primary and secondary schools were successfully destroyed. The state of these pre-tertiary public facilities (primary/secondary schools) has been so pathetic that many of us that attended them now find it difficult to send our children/wards there. In bridging the gap caused by the collapse of these public educational facilities, more private entities stepped in, with many, eventually exploiting the unnecessary space. It is now, almost, all about private primary and secondary schools in Nigeria! However, this does not imply that the entire privately owned educational facilities are without flaws, caused by humans.

For instance, owing to their mercantile mindset, the proprietors of many privately owned educational facilities (with the exemption of some good ones) are mainly interested in the profit to be made from their ‘business enterprise’. These kinds of ‘businessmen’ (and women) are not really interested in using education, as a veritable tool, to develop a high quality human capacity for positive transformation of the society! Owners of these strictly business entities are mainly interested in empowering themselves. It is more morally challenging when these shylock proprietors are the same as those that contributed to the collapse of Nigeria’s public educational facilities. These people need to know what formed the foundation for, and philosophy behind, many of the now successful private educational institutions in Europe and North America. Governments, in those places, did not ‘kill’ public educational institutions for private ones to grow! Anyway, we need not go far into this discussion, here, as it is not intended for this current intervention. There will be time for it in the very near future. Thus, let us quickly veer off, from here, into a very important challenging challenge, also, to educational sector in our dear country.

This challenge, like insurgency and banditry, which started, seemingly, small in parts of northern Nigeria, has grown, at a geometric progression, with our eyes wide open, to become an industry – a lucrative crime industryravaging the whole northern part of Nigeria and boldly moving southwards, unchallenged. There is no need for guess work. It is what we all knew about, all along, but earnestly wished that solution(s) for surmounting it will – out of the blue – be provided by beings from the outer space. We are actually talking about kidnapping/abduction of boys and girls from schools’ compounds/dormitories by group(s) of criminals that have successfully terrorised us, so much, that we have become afraid to publicly call them what they truly are – criminals. Why will people not be afraid in this kind of country where criminals appear to be above the law? Was it not in this country that this atrocious crime (kidnapping/abduction) got politicised, and still is? Have the governments (both past and present) shown us that they have been able to be ‘on top of the situation’ as they were quick to say?

The governments at all levels, especially Federal Government of Nigeriawithout mincing words – have not been able to deliver in the very important area of governance concerning ensuring security for the country’s law-abiding citizens in the north, south, east and west. In order to justify this statement, it is incontrovertible that the public domain is awash with reports corroborating the claims that these criminals have grown by leaps and bounds since April, 2014 when the first, (perhaps there were earlier unreported ones), well publicised successful kidnapping occurred at Government Girls Secondary School, Chibok, Borno State, Nigeria. Since the kidnapping of those girls, simply called Chibok Girls, business has been good for these criminals! In fact, criminals in Nigeria are now emboldened, daily, by governments’ actions/inactions. Like we did in an earlier interaction, we ask again: Are these criminals really non-state actors? Criminality has become business as usual in a country with some of the best brains and hands used in effectively solving security challenges elsewhere! This is really unbelievable! Indeed, insecurity in Nigeria, have unbelievably worsened, to the extent that a high ranking government official was recently quoted to have purportedly said that “government cannot secure all schools”.

Is this not the same Nigeria where one does a night journey from Maiduguri to Lagos? How did we get here? Nigerian governments appear to be giving in to terrorists’ demands. Such are the onesthat revolve round discouraging exposure of law-abiding citizens to Western education. This is a country where the staggering population of out-of-school children especially in northern Nigeria – isalready a threat to future developmental potentials! The terrorists (or non-state actors) are winning while the governments have been caught flat-footed! Or how else do we explain the situation whereby boys and girls are picked, like snails (day and night),from their schools by criminals andvanishing with trace’.Yes, with trace, becauserecent activities of some well placed people visiting these criminals’ ‘hideouts’ indicate that the location(s) of many of these non-state actorsare not unknown to the authorities. We do not want to agree, but some Nigerians are strongly of the opinion, that these non-state actors are working hand in glove with some people at all governmental levels, in the past and now. So, we understand why the fear of being kidnapped, again, to experience the harrowing emotional trauma, has made many to vow not to allow their children/wards go back to school. Therefore, we simply ask: Are the terrorists not winning?

We will continue to contribute towards sincere efforts at rousing Nigerian governments, at all levels, from their deep slumber. This is irrespective of the fact that being in slumber is their comfort zone. We will continue to remind them, in the words of Henry Peter Brougham (1778–1868), that “education makes a people easy to lead, but difficult to drive; easy to govern, but impossible to enslave. They are not to give in to terrorists and other criminals, currently, on rampage in this country or aim,in any way, at ‘driving or enslaving’ Nigerians, because these will eventually backfire.The Federal Government of Nigeria, with almost all the constitutional powers over the country’s security architecture, should sit up and do the correct needful, now. We are not interested in how solution(s) to insecurity in our country can/will be found. What we are interested in is sustainable results, as simple as that! Get the results so that, at least, this major challenge, now, contributing to this phase of progressive decline in the quality of education, festering in northern Nigeria, would be surmounted. History is beckoning to Nigerian governments at all levels. Certainly, if this history will be a wonderful one, the choice is theirs – today.

Nigeria: Auto crash Claims Nineteen Along Kaduna-Abuja road.

At least, 19 persons confirmed dead in a ghastly motor accident at the Kateri axis of the Kaduna-Abuja highway, North west Nigeria, on Sunday.

According to the report, the crash, which occurred late on Sunday evening, involved a commercial DAF trailer and was caused by a combination of speeding, and an exploding tyre, leading to a loss of control, which caused the vehicle to veer into the bush.

A total of fifty-three (53) people were involved in the crash; 16 of these died on the spot, with three others later confirmed dead. Thirty-four (34) sustained injuries which ranged from bruises and cuts to dislocations and head injuries. They were evacuated from the scene by personnel of the Federal Road Safety Corps.

The survivors are receiving treatment in hospital.

Officials of the Kaduna State Ministry of Internal Security and Home Affairs, visited the site of the crash to ascertain the report of events and avoid misrepresentations of the incident.

According to Auwal Idris, the driver, most of the passengers on board the ill-fated trailer were picked at Kara, by a filling station in Lagos, with some to be dropped off at Zaria, while Kano was meant to be the final destination.

Governor Nasir El-Rufai expressed shock and sadness at the report, and prayed for the repose of the souls of those who perished in the crash, while sending condolences to their families. He also wished the injured victims a speedy recovery.

Going further, Governor commended the personnel of the Federal Road Safety Corps for their swift response, and prompt evacuation of the casualties from the scene.

The Governor enjoined drivers on the route to exercise caution at all times and avoid potentially dangerous driving practices like speeding.

The Niger Delta people are now beginning to witness genuine and practical intervention in their lives and environment as opposed to mere linguistic, lackadaisical and chaotic involvement of past management team, Niger Delta Stakeholders said on Sunday in Uyo.

They also praised the Minister of Niger Delta Affairs, Chief Godswill Akpabio, for confronting the challenges of the development of the Niger Delta region and bringing a positive difference in the lives of the people of the oil rich region and their environment.

At a meeting to address key issues in the region, the stakeholders praised former federal Minister of Information, Chief Edwin Clark, for holding NDDC Sole Administrator, Mr. Effiong Akwa, in high regard.

The stakeholders did discuss the challenge posed by the South-South Peoples Democratic Party (PDP) governors.

They said the position of the South-South governors had sinister import and was meant to distract the Federal Government.

“The South-South geo-political zone can no longer be held hostage by a few people whose sole aim is to work against the plans of the Federal Government” the key stakeholders said.

The stakeholders urged President Muhammadu Buhari not to play into the hands of those contributing towards the underdevelopment of the South-South geo-political zone.

Mr. President, we urge you not to be distracted by the antics of those who are jealous of the Minister of Niger Delta Affairs, Godswill Akpabio and are afraid that the progress so far made by the Niger Delta Development Commission (NDDC) in the region may affect their 2023 political ambition’’

Specifically, the key stakeholders praised Akpabio for addressing the needs of the oil producing areas and attending to such priority projects as roads, bridges, electricity, water supply, foreshore walls, jetties and land reclamation

 “The views of the South-South governors are really borne out of crass ignorance and mischief. The Niger Delta Commission is working. Things are really happening in the region. The Commission is embarking on people-oriented projects. There are development projects going on in the region. The South-South governors did not talk from facts at least concerning the current efforts of the Commission to develop the region.”

 The stakeholders, under the aegis of Niger Delta Stakeholders Forum (NDSF) praised the Commission for the duplication and extension of the East-West Road, youth employment and empowerment as well as other agricultural and developmental programmes in the region.

“NDDC and state governments as developmental agencies are not in any way comparable. The six South-South governors, individually and collectively, have little to show for the billions collected as Federal Allocation and Internal Generated Revenue (IGR).”

Briefing news men of the outcome of the meeting, Chairman of NDSF and South-South Front (SSF), Chief John Harry, said the stakeholders commended NDDC and its managers for taking concrete steps to ensure quality service delivery.

“The NDDC is one of the few government agencies that insists on due process in the award of its contracts. All communities in the region expect so much from the Commission.’’

The members of the Forum are drawn from the nine states, civil society and oil producing companies.

 “We know Chief Godswill Akpabio is outshining the South-South governors but that is not enough for the governors to create problems in the region” the Niger Delta stakeholders said.

The President and Founder of Citizens Quest for Truth Initiative, a non-governmental organization noted for its advocacy inclination amongst other positive ideals, Chief Christie Oby Ndukwe says that Probe of South-South Governors over Covid-19 Funds is an effort in futility

 

Oby who was on Niginfo 92.3fm interview monitored by Meinyie Okpukpo, the National Secretary of Citizens Quest for Truth Initiative urged the Governors to consider the need of the Citizens before execution of projects.

 

How many times have you heard that we had governors holding town hall meetings and bringing people from all walks-of-life not select people? How many times have we heard that they are conducting a census house to house, door to door in the rural areas to find out what really the people want, Oby questioned.

 

Continuing, she observed that, “NDDC Act is very clear on the role of the governors; it is advisory, not that they determine, not that they are the one that will constitute who gets what. It is just advisory.”

 

Buttressing her position to an inquiry she quoted Section 11 (I) of the NDDC Establishment Act thus, “There is hereby established for the Commission, a Niger-Delta Development Advisory Committee (in this Act referred to as “the Advisory Committee”) which shall consist of-

 

(a)     The Governors of the member States of the Commission; and

 

(2)    The Advisory Committee shall be charged with the responsibility of advising the Board and monitoring the activities of the Commission, with a view to achieving the objective of the Commission.

 

On her reaction to statement by Senate Committee on Ethics, Privileges and Public Petitions that it will extend 6.2 billion naira COVID19 palliative fund probe to the nine governors of the Niger Delta Region, Oby said governors cannot be probed by the National Assembly over COVID19 palliatives given to them by the NDDC because they are protected under immunity. It will yield nothing as long as the report of the probe cannot be implemented. But if their mission is to ascertain whether they Governors received funds, medical equipment and food palliatives from the Nddc Covid-19 funds approved by the President, then, the right thing to do is to write the Governors for detailed information, to enable the Committee in its probe. Even though, that issue had been severally discussed and deliberated upon by the two NASS Committees on NDDC.

 

“We have so many probes at the end of the day; they end in the trash can. The reports are not implemented and often times these probes are just tool for political witch-hunt or sometimes they need some sort of settlement from the other party. So they now begin to harass them.  I don’t think is gonna be, there will be anything, nothing can come out of that probe if out all the constitution allows that.

 

“I think that the major thing we need to do is to get the law right, get the constitution to be enforced, to be implemented to the letter at any given point in time and forget about this rat-race they are doing”  Oby finally declared.

 

Nigeria 2023: Group Drums Support For Bala Mohammed, Wants PDP to Zone Presidency To North East

Supporters of Bauchi State Governor Bala Mohammed Bauchi have urged the opposition People’s Democratic Party (PDP) to zone the 2023 presidency to North East.

They also urged the major opposition party, APC to hand its presidential ticket to Governor Muhammad if they want to take over power at the center.

Inaugurating the movement, Bala Abdulkadir Muhammad Vanguard (BAM-V), the Kaduna State chairman, Musa Haruna, described the Bauchi State Governor as a detribalised Nigerian who has been able to build bridges over the years.

Haruna argued that Nigeria eagerly need competent, transparent and immensely resourceful leader to steer the ship of Nigeria’s affairs through transparency and good governance.
According to him, “BAM-V Kaduna State Chapter is of the strong belief that for the 2023 presidential election, Nigeria is eagerly in need of competent, transparent and immensely resourceful leader to steer the ship of Nigeria’s affairs through transparency and good governance and in the process save her from the current security challenges and prevent her from disintegration.

“Senator Bala Abdulkadir Mohammed is a detribalized Nigerian devoid of nepotism and has been able to build bridges across years. His appointments as FCT Minister reflected his detribalisation with people from every parts of the country given the opportunity to serve their Fatherland. As a Governor today, he still does this.

“His doggedness and ability to fix the numerous challenges confronting the Nation was seen in his outstanding and impeccable performance as the FCT Minister for six consecutive years, which is yet to be surpassed till date years after he left office.
“We are of the strong view that age is his side and he is a politician without extra baggage, competent transparent and immensely resourceful. He equally possesses the political sagacity and will to not only confront but also successfully tackle the problems bedevilling the country today.

“As a sitting Governor, Senator Mohammed is currently demonstrating this in Bauchi State where he has been able to bring developmental progress to the state and making it the most peaceful state in the North-East despite the zone being the hotbed of insurgency in Nigeria today.

FRSC’s Swift Response To Distress Call Rescues Passengers From Drunk Dvr.

The Ogun State Sector Command of the Federal Road Safety Corps has in a quick response to a distress call, rescued passengers by arresting a drunk driver who was spotted driving so recklessly in such a manner that could lead to road traffic crashes.

According to Bisi Kazeem, the Corps Public Education Officer, the drunk driver was arrested in Kyakyama, Ogere, Ogun State at about 1335HRS when the Sector Commander received a distress call from a passenger who noticed the dangerous way the driver of the vehicle she boarded was driving.

The passenger, one Mrs Matina reported that few minutes into their journey, they noticed that the driver was driving under the influence of alcohol which prompted the passengers to caution him against his recklessness.

She revealed that it was when the driver refused to hid to the warning from all the passengers that the passengers got the FRSC call line from the internet and hurriedly put the call through to the FRSC for rescue.

Kazeem stated that upon receiving the call, the Sector Commander ordered a patrol team from RS2.24 Ogere Unit Command  immediately to effect the arrest of the driver and ensure the impoundment of the vehicle, which was reported to be a white colour Toyota Hiace bus with the following registration details FKJ 991 YA.

Upon arrest and impoundment of the vehicle, the driver was subjected to BAC test and the result was 0.18%, which is  extremely higher than the 0.05% permissible by road traffic regulations.

The Corps Marshal, Federal Road Safety Corps, Dr Boboye Oyeyemi while thanking the passengers, expressed joy over the bravery.

He noted that the conduct did not only prove that they were observant enough to discover the recklessness of the driver, but also proves that that Nigerians are also courageous to report dangerous road use behaviour.

He therefore called on the motoring public to emulate the actions of the passengers, emphasising that road safety is a collective responsibility and  every body’s business. As such all road users must play their role to ensure their own safety and that of other road users.

He also said that the FRSC toll free numbers 122 is always available 24/7 for emergency and prompt rescue services.
