South Africa: Millions Stolen By Bobroffs Be Forfeited To State — Court Rules

The Supreme Court of Appeal of South Africa has dismissed with costs the appeal by Ronald and Darren Bobroff against an order of the North Gauteng High Court granting the permanent forfeiture of more than R103 million.

This came after an application by the National Prosecuting Authority’s (NPA) Asset Forfeiture Unit (AFU) in August 2019.

In a statement, the NPA on Tuesday said the order was the result of “brilliant” cooperation between the South African and Israeli authorities.

The High Court in 2019 ordered that the money be paid into the Criminal Assets Recovery Account (CARA) of the state.

The order was granted in terms of the Prevention of Organised Crime Act (POCA), which provides that property that is used to commit a crime can be forfeited to the state.

“The amount is held in two bank accounts in Israel in the names of Ronald and Darren Bobroff who fled South Africa in March 2016 for Australia. This is after irregularities were uncovered at Ronald Bobroff & Partners Inc (RBP), an attorney’s firm specialising in personal injury claims. The Bobroffs were directors at RBP,” the NPA said.

The NPA said this was based on two issues: firstly, whether or not the high court in Pretoria, which granted the order, had jurisdiction to make a forfeiture order in terms of the POCA in respect of assets situated outside the territory of South Africa which belonged to persons who were currently residents in Australia.

Secondly, whether the National Director of Public Prosecutions (NDPP), had established that the money forfeited was “proceeds of unlawful activities” as defined in the POCA.

The appeal was dismissed on both counts but the affected amount was amended.

The case relates to multiple fee agreements entered into by the Bobroffs with their clients. In some instances, said the NPA, up to three agreements were signed with each client.

“The Bobroffs’ modus operandi was to convince clients to enter into these agreements. The clients were unaware that these agreements were in actual fact null and void and that they were used as a tool by the Bobroffs to commit fraud, theft and tax evasion.

“In addition, the Bobroffs invested a substantial amount of RBP’s monies in an investment account. The account was, however, not reflected as a trust creditor account in RBP’s trust accounting records. The money in the investment account provided the Bobroffs with an opportunity to avoid the taxation of the interest earned on the monies invested as well as with an opportunity to launder funds without being detected,” reads the statement.

The NPA said Israeli authorities initially froze the money in the bank accounts after they became suspicious about transactions being conducted on the accounts by the Bobroffs.

The court found that, in all probability, the money in the bank accounts represents the proceeds of unlawful activities, namely, fraud and/or theft and/or money laundering and that the Bobroffs, in all probability, laundered funds of their clients into the accounts in Israel.

Deputy National Director of Public Prosecutions in charge of the AFU, Adv Ouma Rabaji-Rasethaba, expressed delight at the latest court outcome.

“The judgement…gives us a shot in the arm in our quest to bring back stolen money that is outside the country. We shall embark on mutual legal assistance (MLA) endeavours to bring back the money. There’s no hiding place for the fruits of criminal acts,” she said.

She further warned that attorneys who defraud the most vulnerable would not get away with their illegal acts.

“They must not think that they can steal and hide abroad,” she said

 

Insecurity: Niger State Govt To Strengthen Local Security Outfits

Governor Abubakar Sani Bello of Niger State says his government is beefing up local security outfits in the state to compliment the efforts of conventional security operatives in tackling the insecurity in some parts of the State.

Governor Sani Bello stated this while briefing Journalists on some security efforts after he interacted with some community leaders and the new General Officer Commanding (,GOC), 1 Mechanized Division, Nigeria Army, Major General Danjuma Hamisu Ali-Keffi at the Government House, Minna.

Governor Sani Bello and the GOC haven analysed the security situation in the state came up with necessary plans and strategies on how to tackle the security challenges.

The Governor noted that the local security outfits have been overstretched and overwhelmed, hence the need to strengthen them to compliment the efforts of the conventional security agents.

“The local security agencies as it were in the past were understaffed and overstretched because of the size of the state and manpower deficit”, he said.

He said from his discussions with the GOC, they have agreed to provide more men and equipment to support the effort of the local security agencies.

The Governor said with all indication and assurance the GOC gave, the situation will normalize very soon.

On support received so far from the Federal Government, he said, “I think the support is as good as I expected and I believe more will come, I have no doubt more support will come”.

Governor Sani Bello called for patient, prayers and understanding from the citizens, especially now that there is a change in the leadership of the security agencies.

On his part, Maj. Gen Ali Keffi appreciated the Governor and the people of the state for their support to the troops working in the state.

He assured that they will do their best to restore normalcy in society .

Escalating Insecurity Is Shaking Nigeria’s Corporate Existence—- Forum Warns

Northern States Christian Elders Forum (NOSCEF) says it has viewed with great concern the escalating insecurity, spreading like wild fire across the nation and shaking the very foundation of the nation’s existence.

A statement by the Elders after their Executive Council meeting in Kaduna noted that the new trend of targeting students is most condemnable.

“We appeal to the President to seek every available aid, both internal and external to reverse the trend before we lose our beloved country, Nigeria.

“The country must not be left to go the way of Somalia, ruled by warlords, with a reign of lawlessness, as we see ourselves already drifting into.

“We also condemn the attacks on the military and security outfits in various parts of the country.

“These weaken the institutions that still hold us together as a people, at the cost of their own lives.

“We sympathize with the families of military, police and other security personnel, who lost their lives sacrificially, in the course of their duty of defending their fatherland.

” In this respect we commend the Benue State Governor, Dr. Samuel Ortom, for exposing the criminal elements and his commitment/involvement in helping the military authorities to unearth all those involved in the killing of the soldiers in the course of their lawful duty.

“We urge the military, police and other security outfits to remain undeterred in their commitment to seeking an end the security challenges confronting the nation.

” The President must ensure that the mopping up of all arms is wholesome and must not be implemented with any bias that will make those who comply become even more vulnerable to criminal attacks.

“The implementation team must be broad-based to win the confidence of all and not limited to any favoured segment of the nation.

” NOSCEF urges Nigerians to continue to fast and pray for God’s intervention, for with God, nothing is impossible”, the statement concludes.

Troops Rescue 13 Kidnapped Persons From Bandits in Kaduna

Troops have reported the rescue of 13 kidnapped persons from bandits in Gwagwada, Chikun local government area of Kaduna State, North West Nigeria.

The 13 persons originally from Dutse, went to work at a farm called Tanadi Farm, which is located around Bakin Kasuwa in Gwagwada general area of Chikun LGA.

They were attacked by the armed bandits in the process, according to a statement issued by the Commissioner For Internal Security and Home Affairs, Samuel Aruwan.

Troops on receiving credible intelligence of the abduction trailed the bandits to a forest near Bana village and there engaged them in a gun duel. The 13 citizens were thus rescued. They are listed as follows:

After the operations, the troops discovered that the bandits had shot two volunteers before their arrival. The two deceased were identified as:

Ezekiel Iliya and
Nasara Yohanna.

The bandits also burnt a church and looted some houses in the area.

Receiving the report, Governor Nasir El-Rufai thanked the troops and commended them warmly for the successful rescue operation. He also commiserated with the families of the deceased volunteers, and prayed for the repose of their souls.

The Governor also extended his sympathy to the leadership and members of the razed church over the unfortunate attack, and directed the State Emergency Management Agency to conduct an immediate assessment of the damage.

It has been consistently political unequivocally and universally that the essence of a democratic government or any form of government is good leadership.

This intangible and immaterial element is a veritable remedy and antidote to resolving crisis in any society. Great countries apply the remedy for sustenance, as they are the divert products of statesmen who apply to solve crisis situation.

Great societies are thus, product of good governance affected by good leadership and strong political leaders who are never in short supply. In the case of Nigeria, good governance and leadership have always been lacking.

. Though this is not without exception, as few Nigerians have distinguished themselves through leadership traits.

One of such people is the former governor of Nasarawa State and current Senator Umaru Tanko Al-Makura, whose has answered the calls from APC leaders and stakeholders to vie for the position of the National Chairman of the party in the party’s convention slated for July 2021.

A very principled and highly respected parliamentarian and party chieftain of the governing APC.

A giant among peers not only in terms of intellect, vision and prestige but also in terms of sterling qualities of leadership.

A man endowed with pragmatism high sense of service, dynamism and unalloyed love for the party affairs.

Senator Al-Mukura is man that is naturally loved and admired by the people; a democrat and pivot of mass mobilisation; a man who achieves greatness through assiduousness, self -will and sheer determination; a good listener; a man that remains unruffled even at the height of unwarranted intimidation and provocation; a man with critical thinking-skills.

He is a strong advocate of unity, peace and progress of our great country, Nigeria.

He believes in mega- changes in the social, economic and political sectors and theses must be driven by the current generation of Nigerians.

It is with this spirit that he has shown extra-ordinary commitment to education, electoral reforms, good governance, financial accountability and prudence, party cohesion , socio-economic development ,peaceful inter-religious coexistence ,security of lives and properties, freedom of citizens and rule of law, youth and women inclusion and social justice.

Ta’al quick start in office as both governor in 2011 and Senator in 2019 clearly shows great sense responsibility, exceptional courage, sincerity of purpose and diligent service to Nasarawa and Nigeria which distinguished him as a worthy icon of rare breed whose been etched permanently in the annals of creative and legendary leaderships.

There is no doubt that his legacies shall remain eternal source of inspiration for many generations to come.

In his success story, few people erroneously tend to view it as if he employed underhand tactics to achieve them and, in the process, underestimate his midas touch.

The fact remains that he attained his present height through dint of hard work and unparalleled exhibition of moral discipline.

Always among many there would be one who standout. Even some stars are brighter than others. There is always a man among men.

There is always a man among men. Senator Umaru Tanko Al-Makura that man like the rainbow on the sky he is on evidence to the eyes that sees, for its value and beauty.

One cannot but wonder from which source he drives his rare aggressive energetic zeal and tenacity, in solving party matters within a snap of a finger.

To borrow the words of the classical Greek writer Homer, he is both a speaker of words and doer of deeds. Benevolent and highly spirited party loyalist who is a believer in the delegation of responsibilities to his subordinates for the creation of an incorruptible, efficient, resilient and responsive party system.

It is no longer news that Al-Makura has offered to serve his party in the highest position of National Chairman if the position is zone to his North Central Zone, his experience, antecedent, credibility and charisma are credentials that stand him out.

What is also amusing to some is that the charismatic leader recognized that good governance cannot only come about through visionary and dedicated leaders alone, but also a political platform that must encapsulate the set visions and ideologies of the actions of the individuals concerned.

It is in this wise that Al-Makura blueprint for APC has set a new tone for the actualisation of the objectives should the party trust it future with the former Nasarawa governor.

Kano: Strive To Maintain Ethics & Decorum — Perm Sec.Tells Civil Servants

Staff of the Kano State Civil service Commission have been asked  to continue to maintain ethics and  decorum in discharging their duties

The out going permanent secretary of the  Commission, Alh. Salisu M Gabasawa made the plea while handing over the affairs of the office to his successor, Engr. Mohammad Adamu Musa who was posted from the  Due Process Bureau.

Gabasawa noted with delight, the support and cooperation accorded to him by the management and staff of the commission which resulted in many laudable achievements and urged them to extend the same gesture to the new permanent secretary  for the overall improvement  of civil service commission.

“You may recall that, Governor Dr Abdullahi Umar Ganduje has recently approved the redeployment of some permanent secretary in the state with a view to reinvigorating and rejuvenating  the service for better out put, Salisu Gabasawa is now posted to the ministry of Rural and Social Development as a permanent secretary”, he said.

The New permanent secretary of the commission Engr. Mohammad Adamu Musa, expressed appreciation for the warm reception accorded him and pledged to carry everybody on board for speedy development in the sector.

Engr Adamu solicited the support of all and sundry to join hands together to consolidate the gain so far recorded, and wish the out going permanent secretary a huge success in his new assignment place.

Ealier in his address, the chairman of the commission Engr. Bello Mohammad Kiru welcome the new permanent secretary to the commission and highlighted some of the bottle necks bedevilling the smooth running of the commission and urged the new Permanent Secretary to explore ways of addressing them as a challenge.

He commended both the out-going and in-coming Permanent Secretaries for their good records of service and proven integrity which is worthy of emulation and pledged to continue to give all the necessary support to the Permanent Secretary to succeed in the discharge of his duty.

Fire, Road Accidents Claim 12 Lives in Kano

At least, 12 persons were reportedly lost their lives to fire outbreak, road accidents and other mishaps in Kano State within April 2021.

Confirming the development, the spokesperson, Kano Fire Service, Saminu Abdullahi said the incidences were fatal.

Abdullahi also said properties worth N17.6 million were destroyed in the incidence.

According to him, “We received emergency calls from our twenty seven fire stations across the State in the month (April) under review.

“The calls for range from fire incidence to road accidents, drowning in pond or rivers, fall inside a well.

“We received a total of 94 fire incidence calls, 73 rescue calls and 14 false calls.

“An estimate of N17, 650, 000 million properties were lost to the fire incidences.

“Estimate properties worth N42, 340, 000 million were saved from fire.

“12 lives were lost and 94 lives were saved.

“We use this opportunity to advise people to handle fire with care to avoid inferno, abide by the traffic law to avoid road accidents and to be vigilant on our children movement especially for local swimming in pond or rivers more over to stop our children from playing near well or parching water from well,” Abdullahi however stated.

We Remain Resolute In Defence of Nigeria’s Democracy — Military

Nigerian military high command has reacted to a statement purported to have been made by one Robert Clark SAN, suggesting that current political leadership should hand over power to the military for the purpose of restructuring.

In a statement by its Acting Spokesman, Brig Gen Onyema Nwachukwu, the Military dissociates itself from what it calls anti-democratic utterance and position.

” Let it be stated categorically that the Armed Forces of Nigeria remain fully committed to the present Administration and all associated democratic institutions.

“We shall continue to remain apolitical, subordinate to the Civil Authority, firmly loyal to the President, Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria, President Mohammadu Buhari and the 1999 Constitution as Amended.

“We shall continue to discharge our constitutional responsibilities professionally, especially in protecting the country’s democracy, defence of the territorial integrity of the country as well as protecting of lives and properties of citizens.

“The Military High Command wishes to use this opportunity to warn misguided politicians who nurse the inordinate ambition to rule this country outside the ballot box to banish such thoughts as the military under the current leadership remain resolute in the Defence of Nigeria’s Democracy and its growth.

“We also wish to remind all military personnel that it is treasonable to even contemplate this illegality. The full wrath of the law will be brought to bear on any personnel found to collude with people having such an agenda.

“The current security challenges are not insurmountable. The Armed Forces of Nigeria in partnership with other security agencies are working assiduously to ameliorate the challenge. Nigeria will know peace again. PLEASE BE WARNED, ” the statement concludes.
