FG’s Deduction From Federation Account To Fund Nigeria Police Unconstitutional – Court Declares

A Federal High Court sitting in Abuja, has declared as unconstitutional the Federal Government’s deduction of funds directly from the Federation Account to fund the Nigeria Police Force (NPF) in line with Section 4(1)(a) and (b) of the Nigeria Police Trust Fund (Establishment) Act 2019.

Justice Ahmed Mohammed made the declaration while delivering judgment suit No: FHC/ABJ/CS/511/2020 filed by the Rivers State Government against the Attorney General of the Federation (AGF), Accountant General of the Federation, Revenue Mobilisation, Allocation and Fiscal Commission (RMAFC) and the Minister of Finance on Wednesday.

Justice Mohammed asserted the provisions of Section 4(1)(a) and (b) of the Nigeria Police Trust Fund (Establishment) Act 2019, that requires the Federal Government to deduct 0.05 per cent of any funds in the Federation Account and 0.005 per cent of the net profit of companies operating in the country to fund the police are unconstitutional.

The judge said the provisions of Section 4(1) (a) and (b) in the Nigeria Police Trust Fund Act are inconsistent to the provisions of Section 162(1) and (3) of the 1999 Constitution as amended, that explicitly stated that the payment of total revenue collected by the Government of the Federation, including levies and taxes, must be paid into the Federation Account for sharing among the three tiers of government.

Justice Mohammed said the court agreed with Rivers State contention that, by virtue of Section 162 (3) of the Nigerian Constitution, funds standing to the credit of the Federation Account “can only be distributed among the Federal, State and Local governments in each State of federation and not directly to any agency of the Federal government, including the Nigeria Police Force.”

He said by the provision of Section 162(3) of the Constitution, no other entity, outside the three tiers of government is entitle to partake in the sharing of funds standing to the credit of the Federation Account. And based on this, he said Section 4(1) (a) and (b) in the Nigeria Police Trust Fund Act are at variance with the provision of Section 162(3) of the 1999 Constitution as amended.

Justice Mohammed stated that since the police is an agency of the Federal Government, it is the duty of the Federal Government to establish and maintain the Nigeria Police Force and not the States.

He ordered the Federal Government to refund to the Rivers State Government its share of the funds from the Federation Account that have been illegally deducted since it commenced the deduction of funds based on provisions of Section 4(1) (a) and (b) in the Nigeria Police Trust Fund Act.

Justice Mohammed granted reliefs 1, 2, 3, 4, 5 and 7 as prayed by the plaintiff, and in respect of reliefs 6 and 8 the relate to refund, the judge said they should apply to Rivers States.

The trial judge, meanwhile, declined to grant similar order of refund to the other 35 States on the ground that they were not parties in the suit. According to him, Rivers State as the plaintiff in the suit, did not file it on behalf of other States.

Rivers State governor, Nyesom Ezenwo Wike in his reaction, said the court verdict is a resounding victory for democracy because the Nigeria Police Trust Fund Act which the Federal Government relied on deduct funds from the Federation Account is in contravention of the 1999 Constitution.

“For me, it is a victory for democracy. And I have always told people, it is not whether you must win or not, but it is a matter of when you see issues that you think are in contravention of our Constitution and other laws, there is nothing wrong for you to challenge it, so that the right thing can be done.

“After all, if the money is given back to us, we can still on our own say police, we want to support you with this. But not the Federal Government arbitrarily deducting our money from the Federation Account and putting it to Police Trust Fund. I don’t think that, that is right and I thank God that today the court has made a clear pronouncement on it.”

The governor, acknowledged that though the National Assembly is constitutionally empowered to enact laws, in enacting the Police Trust Fund Act, they went beyond their powers by contravening the provisions of the Constitution of Nigeria.

Speaking further on the order of the court that the State government should be refunded the money deducted from its share to fund the police, Governor Wike said the order will put an end to impunity.

“We are happy that the court has said that they should refund us all the money deducted and luckily the principal parties, Revenue Mobilization and Fiscal Commission, the Accountant General, Attorney General Office they are all involve in the case.

“…It is not about Rivers State, but it is about the impunity, it is about the violation of the constitution as if anybody can wake up one early morning and just decide to do one or two things, which is wrong. And I am happy that the decision we took, we are not wrong and I thank my legal team.”

 

 

 

  Nigeria: Kano Approves Multi-million Naira Gogori, Kabo Roads, Placement of Granite Projects

Kano state Executive Council has given approval for the execution of various infrastructure development projects in both urban and rural areas in the state.

The state commissioner for Information, Malam Muhammad Garba announced this Thursday while briefing newsmen on the outcome of the council’s weekly meeting held at the Africa House, Government House, Kano.

He said the council approvals for the projects include that of a contract for the supply and placement of polished Nigerian granite at Tijjani Hashim (Galadiman Kano) Underpass at the cost of N525, 435, 750.00 million.

The project is aimed at controlling the high level of dampness, modernizing and further beautifying the existing structure.

Malam Garba stated that approval has been given by the council for the revised estimate of contract for the placement of polished granite to cover retaining walls of the existing Underpass at Panshekara/Madobi Road Junction at an augmented cost of N65, 709, 198.00 million.

The commissioner further announced that a contract award has been approved by the council for the reconstruction of 3.35 kilometre Kwanar Gogori (off Shanono Road)-Gogori Town Road in Bagwai local government at the cost of N290, 265, 511.33 million.

The project, when completed, he said, would boost agricultural-cum-commercial activities and ease the transportation of both dry and rainy season’s farm produce, poultry and animal husbandry.

He said other approvals by the counvil is ratification of determination of contract for the completion of Kanye-Kabo-Dubagau Road at the cost of N1, 640, 524, 143.83 billion.

He said other approvals by the council include the release of N25, 559, 600.00 million for the payment of outstanding tuition fees, upkeep allowances and airfare for 30 state sponsored students of Medicine, Physiotherapy, Pharmacy and Information and Communication technTechnology at SSIMS and RC, Dayananga Sagar College of Pharmacy Medicine/ Dayananga Sagar University and Dayananga Sagar College of Physiotherapy, India.

Other approvals by the council, according to him,  include digitization programmes of Kano state public schools at the cost of N32, 940, 000.00 million and the release of N19, 800, 000.00 million for the hosting and sponsorship of an annual tournament to immortalize the former Head of State, Late General Murtala Ramat Muhammad.

Malam Garba added that approval has been given for the release of N22, 220, 000.00 million for the conduct of a two-day technical workshop on agency banking to Qur’anic teachers (Alarammomi) as part of measures to empower Tsangaya schools to become self-reliant and create poverty/begging free Tsangaya dwellers.

The commissioner explained that basic equipment/materials needed for each Tsangaya school to be effectively initiated into the agency banking industry include finger biometric machine, laptop, camera, POS android device, among others.

International Customs Day: South Africa Scales Up Digital Transformation To Facilitate Trades

The South African Revenue Service (SARS) Customs division will scale up digital transformation and
increase data usage to improve the facilitation of trade, revenue collection and compliance by import and export traders across South Africa’s borders.

The commitment was on Wednesday made by SARS Commissioner Edward Kieswetter at the annual International Customs Day.

Kieswetter said digital transformation and the increased use of data is necessary to combat the increased sophistication of organised crime, and better manage the expanding volume and complexity of international trade.

The Commissioner reported that the Customs Modernisation Programme led to an improvement in the average case turnaround time on interventions by 22%, as at December 2021.

The programme has also seen frontline interventions come down from an average of 109 hours in March 2020 to 38 hours as at December 2021. It also reduced the stop rate for Authorised Economic Operators by 86%, leading to savings in cost and time.

“We have improved our risk-based interventions to detect and deter illicit trade by an average success rate of 54% by the end of December 2021, which has raised an additional R2 billion in revenue.

“As at December 2021, SARS Customs more than doubled the value of seizures compared to the previous year, from R1.5 billion to R3.5 billion, including narcotics, clothing and textiles,” Kieswetter said.

The SARS Commissioner said several other initiatives, built on increased use of data and expanding the data eco-system, had made significant progress as part of the SMART border concept.

“We are currently piloting the number plate recognition system at Beit Bridge, with the help of key stakeholders such as the Freight Association and Technical Services Providers Association. More than 99% of all cross-border truck manifests are now reported electronically to SARS prior to the arrival of the truck at the border, which includes the truck registration details.”

To extend further practical benefits to traders and increase compliance, the Single Window platform is being implemented, in partnership with Transnet. The platform will allow marine carriers to submit reports once to both entities to improve port efficiencies.

The implementation of this platform will be followed by a National Single Window to enable traders to submit all cross-border documents through a single point of entry to government, and enable other border agencies to view, stop and detain goods for agricultural, health and safety concerns.

“Another project to combat illicit financial flows brings together data from SARS, commercial banks and the South African Reserve Bank,” Kieswetter said.

He commended SARS for starting its journey of modernisation and embracing a technology-enabled and insight-driven culture as part of its operations. However, SARS will need partnerships built on mutual respect, trust and a commitment to serve the greater public good, the Commissioner said. – SAnews.gov.za

Nigeria: Zulum Approves N50m Grant, Six Doctors, Nurses, Ambulance For Private-Community Hospital

Towards increasing the capacity of private health institutions to complement Government in healthcare delivery, Borno Governor, Babagana Umara Zulum has approved N50m grant, ambulance, drugs, and other medical facilities to Sunni Hospital, Maiduguri.

Zulum announced the donation on Wednesday when he paid an inspection visit to a hospital located in Abbaganaram area of the metropolis.

Sunni is a private community-based hospital built by Maiduguri-based businessman, Alhaji Tijjani Bolori who died by the end of last year (2021).

… Offers six doctors, nurses

Governor Zulum also asked the hospital to recruit two doctors and four nurses to boost their staff strength, while the Borno State Government will shoulder the monthly salaries and other entitlements of the six medical personnel while they remain staff of Sunni hospital.

“Submit requirements for us to shoulder the payment of two medical doctors as well as the nurses. I will imsha’Allah give approval of the payment of their salaries” Zulum said.

The Governor also paid tribute to the late founder of the hospital.

“I am delighted to be here this morning to see things for myself, but let me pay a tribute to late Alhaji Tijjani Bolori for the wonderful things he did in his lifetime. Bolori has touched almost all the sectors of human capital development, in healthcare services, and education among others. We pray that Almighty Allah will admit him into Jannatul Firdaus” Zulum said.

.. Orders remodeling of Maiduguri eye hospital

In a related development, Governor Zulum has ordered the remodeling of the Maiduguri eye hospital.

He ordered the construction of new staff quarters and operation theater to serve the increasing healthcare needs of the State.

Nigeria: Let’s Make Northeast’s Master Plan Realistic, Achievable – Zulum Tasks Stakeholders

Borno State Governor, Professor Babagana Umara Zulum on Tuesday charged stakeholders including himself to work together in developing an ambitious but realistic and achievable master plan for the stabilization and development of Adamawa, Bauchi, Borno, Gombe, Taraba and Yobe States which make up the six States in the northeast geopolitical zone.

Zulum who chairs the forum of northeast Governors spoke as special guest of honour of a multi-stakeholder consultation forum with the theme: North East Stabilization and Development Master Plan (NESDMP) project, which was hosted by the Northeast Development Commission, NEDC at the Congress Hall of Transcorp Hilton in Abuja.

The forum was attended by Ministers of Humanitarian Affairs, Disaster Management and Social Development, Hajia Sadiya Umar Farouq and some Ministers, Chief of Defence Staff, General Lucky Irabor, Inspector General of Police, Baba Usman Alkali, and National Security Adviser Major-General Babagana Monguno(rtd), and other top officials.

Addressing the participants, Governor Zulum said:
“Let me start by thanking President Muhammadu Buhari and the Minister of Humanitarian Affairs for their interventions in ensuring that there is peace in the North East. We all understand the crucial role that consistency can play in bringing back peace, stability and prosperity in the North East in particular and Nigeria in general. This master plan must be ambitious, broad, brave, comprehensive to cover the whole scope of issues in the Northeast”

“The plan should outlive our tenures in office. It should be a reflection of our doggedness to rise from the ashes of destruction into the bright and welcoming place of peace and development. Our aspirations, as Governors and people of the region, therefore, should be to build back better everything that we lost and much more. The work may appear to be daunting, but rest assured that the bulk will be made easier than we can imagine through the unflinching support you will receive from the leadership in the northeast as a whole. Our respective States in the North East will make available plans for the purpose of alignment and synergy that will deliver better quality service to the people of the northeast” Zulum added.

“Using Borno State as an example, we will make available our 25-year development plan as a starting point on our own side. My colleagues will provide their’s as well. It is important that we are not starting from ground zero. Building on efforts already on ground, we should ensure that we are not just making plans that don’t talk with one another. We should make plans for common purpose governed by good leadership and commitment to finish whatever we start” the Governor said.

“This plan should not be a political plan. It should be a people’s plan. A strategic direction to bring back peace in the North East. I implore everyone involved to help us bring back the lost glory of the north east” Zulum urged.

In her remarks as Chief Host, Minister of Humanitarian Affairs, Disaster Management and Social Development, Sadiya Umar Farouq explained that “the necessity for a North East master plan is stated in  SECTION 8 (1C) of the NEDC Act, which lists as one of the functions of the NEDC to ‘Develop a Master Plan based on the needs assessment of the zone to be known as the North East Stabilization and Development Master Plan (NESDMP), which shall contain programmes and schemes that promote and facilitate the physical and  socio economic  development of the North East Zone, and the estimate of the time and costs for implementing such programmes and schemes”.

On his part, the Chief of Defence Staff, General Lucky Irabor, who was represented by Commander, Defence Headquarters’ Garrison, Major-General Preye Fakrogha, pledged the military’s support towards realizing the plan and its implementation.

Managing Director/CEO of the North East Development Commission (NEDC) Mohammed G. Alkali recalled that “before yesterday’s larger forum, the NEDC had consulted relevant stakeholders in a bottom-up approach”, noting that so far, engagements on the Master Plan were held at grassroots level in all the 112 LGAs” across the six States in the northeast.

“The event we are witnessing today is one of the high points of such consultations because all the Federal MDAs and security agencies execute priceless and impactful interventions in the North-East Region” the MD said.

Goodwill messages were delivered by the dignitaries that included the Chairman, Senate Committee on Special Duties, Sen. Yusuf A. Yusuf, Minister of Communications and Digital Economy Prof. Ali Pantami, Minister of Power, Mr. Abubakar Aliyu, Minister of State for Education, Chukwuemeka Nwajiuba, Minister of Health, Dr. Osagie Ehanire, the Inspector General of Police, Usman Baba Alkali, among other top officials.

Gender Based Violence, Crime Against Humanity- Says Kaduna LG Chairman.. As AMDF Visits.

The Chairman Kajuru Local Government Council in Kaduna State., North West Nigeria, Mr Ibrahim Gajere has pledged his unflinching support for advocacy against gender based violence in his Area.

Gajere made the commitment when an Advocacy team of the Africa Media Development Foundation, AMDF implementing the Rise Up Project paid him a visit, Tuesday at the Council’s Secretariat.

To practically demonstrate the commitment, Mr. Gajere mandated his wife, Asabe to work with the team towards achieving the desired objectives of the project.

The Council Boss also assured the Community Based Action Volunteers, COMBAV of the project, of his support in the prevention of the gender based violence, especially against women and girls.

He described gender based violence as a crime against humanity.

Earlier, the Project Manager and Rise Up Fellow, Mr. Benjamin Maigari, thanked the Council Chairman for receiving members of the team despite his tight schedule.

Maigari also congratulated his host for his victory at the LG polls and wished him a fruitful tenure.

He told the Chairman that the team which had made similar visit to his immediate predecessor, came with some members of the Community Based Action Volunteers, to intimate him with the project and also seek his support in preventing the violence.

Mr. Maigari was optimistic that the State Government would formulate a policy establishing and recognizing the work being carried out by the COMBAV team.

Members of the COMBAV team were selected from each of the Six communities where the project is being implemented.
The Rise Up Project is also being carried out in Kaduna North Local Government Area with the same number of communities benefitting.

 

 

Chibok Attack: 4 Killed, 110 Buildings Burnt, Zulum Meets Families Of Abductees

Governor Babagana Umara Zulum was in Chibok town on Monday following a recent attack on three communities: Kawtakare, Korohuma and Pemi  in the LGA. The Governor met families of 22 women and two men abducted by Boko Haram/ISWAP during the attack.

Zulum invited relatives from the three affected communities made up of men and women and hosted them at the Government lodge in Chibok town.

Insurgents had recently attacked Kawtakare on January 21, 2022, Pemi on January 14 after previous one on Korohuma on December 30, 2021.

“We are here in Chibok to commiserate with you, immediate families of our sisters and brothers abducted as well as four of our brothers killed by the Boko Haram terrorists in these unfortunate incidents. We share your pains and we pray this act will not happen again” Zulum said.

After meeting the families, the Governor interfaced with heads of security agencies and discussed gaps and ways to enhance security in the communities.

Zulum observed that four local government areas: Biu, Askira, Chibok and Damboa were faced with serial attacks from the members Boko Haram/ISWAP terrorists in recent times, assuring that his administration will not relent in providing additional support to security operatives, to contain the challenges.

.. Four people were killed, LG Chairman says

briefing the Governor, chairman of Chibok Local Government Area, Umar Ibrahim said in addition to the 24 people abducted, three persons were killed by the terrorists during separate attacks on three communities.

The Chairman disclosed that a combined number of 110 buildings made up of 73 houses, 33 shops and four churches were burnt alongside eight vehicles and three tricycles.

Zulum directed that an assessment report containing all destructions perpetrated by the terrorists in the three communities be submitted to him.

Governor Zulum commended the chairman of Chibok Local Government for his responsive leadership.

“Let me specifically commend the efforts of the Local Government Chairman, because despite the very limited resources, he has been doing his best to ensure that dividends of democracy are provided in Chibok” Zulum said.

The Governor was accompanied to Chibok by the member representing Chibok at the state assembly, Hon. Aimu Foni, Commissioner of Poverty Alleviation, Nuhu Clark who also hails from Chibok, and commissioner for Local Government and Emirate Affairs, Sugun Mai Mele who oversees all of Borno’s 27 LGAs.

Nigeria: Abdul Isiaq Emerges SDP National Chairman, As NEC Suspends Agunloye, Gabam

Former deputy national Chairman (North), of the Social Democratic Party, (SDP) Dr. Abdul Ahmed Isiaq, has emerged the new National Chairman of the party.

The National Executive Committee(NEC) unanimously approved Dr Isiaq, as the New National Chairman, while Engr Simon Adewole Adeshina becomes the New National Secretary.

According to the NEC, the illegal suspension of Dr Abdul Ahmed Isiaq and that of Kano Chairman Alh. Ado Bello was thrown out and were restored to their various positions ante. This allowed them to be admitted into the NEC meeting before it went further.

Equally, the suspension of Alhaji Kolawole Balogun elstwhile Oyo State Chairman and Dr Webster Okwonko, the Anambra State elstwhile Chairman was lifted immediately along other suspensions.

The NEC which held in Abuja on Saturday, suspended the acting national Chairman, Dr Olu Agunloye and national Secretary, Shehu Gabam.

The two party leaders were alleged to have committed various abuses of the constitution.

The NEC also accused them of cornering the fees for expression of interest and nomination forms paid by the party’s governorship aspirant in the recent Anambra State election, Obinna Uzor.

A communique of the party stated that; “The NEC considered the various abuses of the constitution by the following underlisted officers and therefore agreed by majority to suspend, Alhaji Shehu Gabam and Dr. Olu Agunloye.”

The NEC at the meeting discussed various issues concerning the Party and observed as follows; “The wanton disregard to the provisions of the SDP constitution especially Article 12.5.1(iv); 12.2.2(viii) and Article 19.4 to suspend some officers from the Party.”

The NEC added that it is desirous of reversing the ugly trend and has resolved to do so.
