Texas shooting: US Air Force ‘failed’ to flag gunman’s criminal history

The US Air Force has said it is investigating its apparent failure to enter information about Texas gunman Devin Patrick Kelley’s criminal history into the national database.

Ex-airman Kelley was court-martialled for domestic violence in 2012, and was barred from owning or buying guns.

But last year he was able to purchase a rifle he used in Sunday’s attack on a small church outside San Antonio.

He killed 26 people and fled the scene. He was later found dead in his car.

Police said he died from what appeared to be a self-inflicted gunshot wound after being chased by armed bystanders.

Kelley was also shot in his leg and torso by a citizen, the regional director for the Texas Department of Public Safety, Freeman Martin, was quoted as saying by the Associated Press.

In a statement, the Air Force said: “Initial information indicates that [Devin] Kelley’s domestic violence offense was not entered into the National Criminal Information Center database by the Holloman Air Force Base Office of Special Investigations.”

It said it was now – together with the Department of Defense – investigating the handling of Kelley’s criminal records.

Texas Governor Greg Abbott earlier said Kelley, 26, should not legally have been allowed to own a firearm, after having been denied a gun owner’s permit by the state.

Kelley bought the rifle from the Academy Sports + Outdoors shop in San Antonio. The store issued a statement sending “deep condolences” to the victims’ families.

Mother-in-law argument

Kelley was armed with the semi-automatic rifle and two pistols when he attacked the First Baptist Church of Sutherland Springs during Sunday services.

He had argued with his mother-in-law before the rampage, officials said.

Kelley called his father after he was shot by an armed bystander and said he did not think he would survive.

“This was not racially motivated, it wasn’t over religious beliefs,” said Mr Martin.

“There was a domestic situation going on with the family and in-laws,” he said, adding that Kelley had sent threatening texts to his mother-in-law.

“We know that he expressed anger towards his mother-in-law, who attends this church,” Mr Martin added.

On Monday evening, a vigil was held in Sutherland Springs.

In one corner of the field, music played, people prayed, and hundreds of people held their hands in the air, the BBC’s Owen Amos reports. In another, a floodlight illuminated 26 crosses – one for each person shot dead.

People queued to shake Mr Langendorff’s hand. At one point, a couple embraced him, and they stood in prayer for two or three minutes, our correspondent says.

Wilson County Sheriff Joe Tackitt said between 12 and 14 children were among those killed in the attack in Sutherland Springs, a small town 30 miles (50km) south-east of the city of San Antonio.

The youngest of those who died was only a year old.

As many as eight members of the Holcombe family were killed in the shooting, the Washington Post reported.

The BBC spoke to the Holcombes’ neighbour Pauline Garza, who said the family did not come back from church.

The First Baptist Church’s pastor, Frank Pomeroy, told US media his 14-year-old daughter, Annabelle, was among those killed.

Twenty people were also wounded.

Who was the gunman?

Kelley was court-martialled in 2012 after he was accused of assault against his wife and step-son. He was sentenced to 12 months’ confinement.

He received a “bad conduct” discharge two years later, according to Ann Stefanek, a US Air Force spokeswoman.

Gov Abbott said: “It’s clear this is a person who had violent tendencies, who had some challenges, and someone who was a powder keg, seeming waiting to go off.”

Kelley worked till last July as a security guard for an amusement park run by the Schlitterbahn company in New Braunfels near Sutherland Springs.

His employment was “terminated” after just over five weeks, the company said.

He had a licence to work as an unarmed security guard, a job that police described as “similar to a security guard at a concert-type situation”.

“There were no disqualifiers entered into the national crime information database to preclude him from receiving a private security licence,” police said.

US senator Rand Paul suffered serious injuries during an assault at his Kentucky home, it has emerged.

He is said to be recovering from five broken ribs and bruises to his lungs. A spokesman said the Republican senator is in “considerable” pain.

Initial reports had suggested that Mr Paul’s injuries were only minor.

He was assaulted at his gated community home in Bowling Green, Kentucky, on Friday, allegedly by a neighbour who has since been charged with assault.

“Senator Paul has five rib fractures including three displaced fractures,” Doug Stafford, a senior adviser to Mr Paul, said in a statement reported by US media.

“This type of injury is caused by high velocity severe force.

“It is not clear exactly how soon he will return to work, as the pain is considerable as is the difficulty in getting around, including flying.”

Mr Paul was mowing his lawn at the time of the attack, reports WAVE-TV, a Kentucky television station.

The Republican “was blindsided and the victim of an assault” on Friday, a spokeswoman for him was quoted by US media as saying.

On Sunday, the senator tweeted that his wife “Kelley and I appreciate the overwhelming support after Friday’s unfortunate event. Thank you for your thoughts and prayers.”

Rene Boucher, 59, has been charged with fourth-degree assault, police say.

The two had a previous disagreement about a property line involving a creek behind the senator’s house, NBC News reports.

Matthew Baker, a lawyer for Dr Boucher, said in a statement that the dispute was “trivial”.

“Senator Paul and Dr Boucher have been next door neighbours for 17 years,” said the attorney.

“They are also prominent members of the local medical community and worked together when they were both practising physicians.

“The unfortunate occurrence of November 3rd has nothing to do with either’s politics or political agendas.

“It was a very regrettable dispute between two neighbours over a matter that most would regard as trivial.”

Mr Paul, seen as representing the libertarian wing of the Republicans, ran for the party’s presidential nomination in the 2016 election, but dropped out after a fifth place finish in the Iowa caucuses.

An ophthalmologist, he represents Kentucky in the US Senate and is the son of former Congressman Ron Paul, who ran for president several times.

Liberia’s Supreme Court has halted the presidential run-off amid allegations of “irregularities and frauds”, with just a day’s notice.

It says the poll cannot proceed until the electoral commission has “urgently and expeditiously” investigated the claims.

The allegations were made by the Liberty Party’s Charles Brumskine, who came third in the original vote.

No new date has been set for the poll which was scheduled for 7 November.

Former football star George Weah and Vice-President Joseph Boakai are due to face each other in the second-round vote.

The winner will replace Nobel Prize winner President Ellen Johnson Sirleaf, Africa’s first elected female head of state.

Paradise Papers documents raise questions over African mining deal

One of the world’s largest firms loaned a businessman previously accused of corruption $45m and asked him to negotiate mining rights in a poor central African nation, the Paradise Papers reveal.

Anglo-Swiss company Glencore made the loan available to Israeli billionaire Dan Gertler, a notorious middle man with a close relationship with senior figures in the DR Congo government, in 2009.

Mr Gertler was asked to negotiate a new deal for a mining company in which Glencore had a significant stake, which campaigners say cost DR Congo hundreds of millions of dollars.

He and Glencore deny any wrongdoing.

Glencore agreed to pay Dan Gertler $534m (£407m) to buy him out of their shared mining interests in DR Congo in February this year.

The new details came to light in the Paradise Papers, a leak of more than 13.4 million documents, many from within Appleby, one of the world’s leading offshore law firms.

The central African country of DR Congo has been mired in violence and corruption for decades, leaving more than half of its population living below the poverty line.

But the country’s vast mineral resources are worth hundreds of millions of dollars a year for those that can access them.

This includes Glencore, a huge Anglo-Swiss mining and commodity trading company.

By some measures it is the 16th largest company on the planet.

For many years Glencore has been involved in mining in DR Congo, in particular the production of copper.

The company says it has invested $50bn there. Ten years ago it had an 8.52% stake in a company called Katanga which had the rights to mine copper in the south of the country.

In June 2008 Katanga’s board, which contained a senior Glencore figure, received some bad news.

The DRC government under President Joseph Kabila wanted to renegotiate the terms of its mining licences. Glencore had already invested $150m in Katanga but this could have been wasted if it was unable to mine.

The state-owned mining company Gécamines wanted $585m (£409m) in an “access premium” to allow the exploitation of copper and cobalt at the mine.

The previous agreement had been for $135m (£94.5m).

Documents contained within the Paradise Papers show Katanga’s board felt the demands of the DRC authorities were “quite unacceptable”. For the first time, it is possible to see that the directors decided to call for the help of an Israeli businessman called Dan Gertler.

“Dan Gertler, who had a substantial indirect interest in the company, should be given a mandate from the board to negotiate with the DRC authorities,” Katanga’s board minutes from June 2008 show.

“The board… should approach Mr Gertler to see whether he was prepared to act in this way.”

Mr Gertler was asked to negotiate an agreement on Katanga’s behalf.

At around the same time, Glencore agreed to lend a company in the British Virgin Islands called Lora Enterprise $45m (£31.5m).

Lora Enterprises was controlled by Mr Gertler’s family.

Glencore then loaned Katanga $265m (£185m). This was later converted into shares in the company, allowing Glencore to become its biggest shareholder. The loan to Lora Enterprises allowed Dan Gertler to maintain his stake in the mine. Although Mr Gertler says he did not benefit in any way from the loan.

Katanga announced the larger of the loans to the Toronto Stock Exchange in February 2009, but the details around it were sparse until now.

The terms of the loan to Mr Gertler’s company show that if he failed to deliver a new agreement for the rights within three months, Glencore would have been entitled to demand immediate repayment of the loan.

The Paradise Papers documents suggest Mr Gertler was quickly successful. Gécamines reduced the access premiums it was asking for from $585m to $140m, which was close to the original agreement, saving Katanga $445m.

Pete Jones from anti-corruption campaigners Global Witness said deals similar to the one Glencore was able to strike have had serious consequences for DR Congo.

“For a country that dependent on it natural resource wealth, deals like this which just suck money out of the economy have hugely negative consequences for DR Congo.”

Mr Gertler disputes that it was a poor deal for the DRC and says “Gécamines benefitted significantly from the new JVA including Katanga’s release of copper and cobalt reserves to Gécamines worth $825m.”

Glencore told the BBC the $45m loan to Lora Enterprises was made “on commercial terms and was negotiated at arm’s length”.

It also said it was repaid in full by 2010. Lawyers for Mr Gertler said it’s not unusual for a lender in a mining deal to demand repayment of a loan if a joint venture fails. They went on to say that “neither Lora Enterprises nor Mr Gertler nor any company or person related to them received the loan funds directly”.

Mr Gertler’s notoriety in DR Congo goes back almost two decades. In 2001 the UN produced a report that accused him of exchanging weapons and military training in part of a deal to secure a monopoly on diamond mining rights.

In 2013, a report by the Africa Progress Panel, led by former UN Secretary General Kofi Annan, suggested Dan Gertler’s companies had won mining rights in DR Congo at well below their true value. Lawyers for the Israeli businessman deny the allegations made in the 2001 and 2013 reports.

Last year, hedge fund Och-Ziff agreed to pay $412m to settle a case brought by US authorities accusing it of paying bribes in several African countries. Prosecutors described, but did not name, an Israeli businessman who they claimed paid “together with others, more than $100m in bribes to obtain special access to, and preferential prices for, opportunities in Congo’s mining sector”.

Dan Gertler denies that he did this. Perhaps most significantly, Mr Gertler was also known to be a close friend of a man called Katumba Mwanke, a key advisor to President Kabila before dying in 2012.

Daniel Blint-Kurti from the NGO Global Witness, which has been investigating the relationship between Dan Gertler and Glencore for several years, says the company should have been wary of working with the businessman.

“By hiring someone close to the Congolese president and pumping him with cash and mandating him as their man in negotiations they were running an extremely high risk,” he said.

Dan Gertler’s lawyers told the BBC that “[He] is a respectable businessman who contributes the vast majority of his wealth and time to the needy.”

Zimbabwe politics: Mugabe sacks ‘disloyal’ Mnangagwa

Zimbabwe’s Vice-President Emmerson Mnangagwa has been removed from his post, the country’s government has announced.

Mr Mnangagwa, 75, had displayed “traits of disloyalty”, Information Minister Simon Khaya Moyo said.

His removal makes it more likely that President Robert Mugabe’s wife Grace will follow in her husband’s footsteps as leader of Zimbabwe.

She had earlier called on her husband to remove his vice-president.

“Mr Mnangagwa’s conduct in discharge of his duties is inconsistent with the responsibilities,” the information minister said.

“The vice-president has exhibited traits of disloyalty.”

Mr Mnangagwa, a former intelligence chief, had been a leading candidate to succeed President Mugabe, 93.

His sacking means Grace Mugabe is expected to be appointed vice-president at a special congress of the ruling Zanu-PF party next month.

Mrs Mugabe had earlier called for the party to expel Mr Mnangagwa, according to the state-run Herald newspaper.

Addressing members of indigenous church groups at a rally in the capital, Harare, on Sunday, Mrs Mugabe said: “The snake must be hit on the head.

“We must deal with the real snake behind the factions and discord in the party. We are going for the congress as a united party.”

Last month, she warned of plans to stage a coup, hinting that supporters of Mr Mnangagwa were behind the alleged plot.

Mr Mnangagwa met the president earlier as part of the routine Monday briefing. After another meeting was held with top government officials, a statement was read to the press by the information minister.

It said the president was exercising his authority in accordance with the country’s constitution. The statement is almost verbatim of the one used to fire Mr Mnangagwa’s predecessor three years earlier. It said he had demonstrated “little probity in the execution of his duties”.

Mr Mnangagwa has worked closely with Mr Mugabe for more than 40 years, serving as his special assistant during the liberation war in 1977.

His nickname in the party was the “crocodile”, so-called due to his shrewdness. As yet, he has not commented on his dismissal.


Mrs Mugabe, the head of the Zanu-PF women’s league, and Mr Mnangagwa have been seen as the front-runners in the battle to succeed Mr Mugabe when he dies or steps down.

Mr Mugabe has been in power in Zimbabwe since 1980. He was elected president in 1987, having previously served as the country’s prime minister. He is planning to contest next year’s elections.

Earlier, the youth league of the Zanu-PF party called on President Mugabe to sack Mr Mnangagwa, and to replace him with the first lady. They accused Mr Mnangagwa’s supporters of heckling Mrs Mugabe at a rally in the second city, Bulawayo, and denounced them as “rebels”.

However, the move to appoint Mrs Mugabe as her husband’s deputy in government has been criticised by a leading opposition MP.

In a tweet, Tendai Biti condemned the “dynastic capture of the state”.

Kaduna, (Nigeria)– Speaker House of Representatives, Yakubu Dogara, has stated that contrary to beliefs in some quarters, the Legislature and the Executive are not rivals but partners in progress.
Dogara, who spoke when he received in audience the new Secretary to the Government of the Federation. Boss Mustapha, in his office on Monday, described the appointment of Mustapha as “a round peg in a round hole, or a square peg in a square hole”, adding that the president “hit the nail on the head”.
“He said the visit to the National Assembly by the new SGF is unprecedented in the history of the parliament saying, “it’s never been done. In those days it was invitations extended to them, then a discussion whether they’ll appear at all would ensue. In some cases, some members of the Executive would go to court on the basis of legislative summons.”
“That is because powers of every sort usually led to abuses. So the rule that people always use to guard was that: “power corrupts, and absolute power corrupts absolutely”. And that is why we have the three Departments of Government, The Legislature, The Executive and the Judiciary, all of us doing the work of democracy. So it was an idea of the founding fathers of democracy that it would take some kind of cooperation and consensus among the different Arms of Government for us to make progress as a people.”
“We want to reassure you of our desire to work with the Executive in order to see that we deliver the goods for the people. As a matter of fact for us, there really is no distinction in government, it’s just ignorant people who tend to make these distinctions. If the Executive fails, there’s no way the Legislature would be exonerated, we are all guilty.”
“I’ve always been mindful of our place in history, that is why we have organized this House with the leaders that you see here and some of the Members of the House of Representatives to always work on the policies and programmes of Government with little or no resistance, bearing in mind that if we succeed, we succeed together and if we don’t succeed history would say, you’re a Speaker, you’re a Leader and a Member of Parliament when this Government failed.”
Speaking earlier, the SGF recalled the role played by Speaker Dogara in the process that led to the victory of the All Progressive Congress in the 2015 General elections.
“Let me single out not for any reason, the Speaker. I remember when this whole enterprise started, we were asked to serve in the national convention committee with you. You were the nominee of the House of Reps in that committee and we worked for months to put up a convention and a selection process that is adjudged to be the best ever in this country. You worked with us in spite of your numerous schedules in the National Assembly and what eventually happened in Lagos was a product of your input, commitment and dedication that you had put into the enterprise. So you were part of the process through which President Muhammadu Buhari emerged as our candidate in December of 2014,” he said.
 Mustapha also thanked  the leadership of the House of Representatives for standing with the government of President Muhammadu Buhari saying, “I bring you the warm greetings of the President of the Federal Republic of Nigeria and to also extend his thanks to your leadership in the House of Representatives for the level of progress that has been achieved thus far in the area of the primary responsibility.”
He acknowledged that without the support extended by the Speaker to the President, “the modest efforts that have been achieved would not have been achieved to date so I want to particularly thank you with your leadership for maintaining stability in the body polity and for also ensuring that whenever there is a call to duty, you attend to the matters of state expeditiously.”
Mustapha maintained that the National Assembly are not competitors to the Federal executives, but that they are “joint owners of this Enterprise”

Kaduna, (Nigeria)– Sage Foundation in partnership with the Bricon Foundation, Nigeria-based non-profit organisations are to raise about N3.6 million to support cancer patients that cannot afford medical treatment.

The two foundations have helped to raise awareness about cancer and assisted cancer patients and their families, in the ‘Keeping Hope Alive Challenge’.

Every year, it is estimated that more than 80,000 Nigerians lose their battle with cancer, and more than 100,000 new cases are recorded.

The Keeping Hope Alive $10k Challenge has phases, that was, the ‘Walk the Talk cancer walk in Lagos, on Friday, 27 October, to raise funds and create awareness about breast cancer.

The Sage Foundation appealed to colleagues, business partners, customers and the wider community to support the cause by getting people to sponsor their walk, the proceeds of which would go towards the Keeping Hope Alive fundraising initiative.

“Of the two million Nigerians living with the disease, life-saving medical treatment is not an option, likely because of the high cost or because there are not enough support centres equipped to handle the disease” experts say.

“The Keeping Hope Alive Challenge forms part of the Sage Foundation’s global $1 million challenge which aims to raise about $1 million to support charities around the world,” says Magnus Nmonwu, Regional Director for Sage in West Africa.

“When detected early, cancer is treatable, and it’s not right that millions of people are affected because they cannot afford medical care. The Sage Foundation is committed to building opportunities in local communities and we believe that, together, we are stronger against cancer.

“Nigeria has the worst cancer death rate in Africa, at a shocking 80 per cent. Majority of deaths are due to late presentation or inaccessibility to medical care.

“At Bricon, we believe that, through awareness, early detection and providing appropriate and timely support to cancer patients and their families, we can bring that figure down and make a difference in millions of lives,” says Abigail Simon-Hart the co-founder of The Bricon Foundation.

The Bricon Foundation was established to provide practical support to cancer patients and their families. This includes funding for treatment, diagnostic tests and medication, subsidizing or providing free mastectomy products, and providing training to local nurses and doctors supported by International partners.
