Kano APC Leadership Tussle: Party Chair Challenges Court Jurisdiction On Intra- party Cases

The Chairman, Kano State Chapter of the All Progressives Congress, Abdullahi Abbas has filed a preliminary objection challenging the jurisdiction of a Federal High Court sitting in Kano to entertain interlocutory injunction filed by aggrieved factional leader, Ahmadu Danzago.

Danzago had dragged the party Chairman and Secretary, Abdullahi Abba and Ibrahim Sarina as 1st and 2nd defendants respectively to the court seeking that the court in the interlocutory injunction restrained the duo from parading themselves as Chairman and Secretary on the ground that both executives did not resign their positions as caretaker Chairman and Secretary before contesting the substantive position of the party in the last October party Congress held in the state.

When the matter came up on Tuesday for hearing before Justice A. M Liman, counsel to 1st and 2nd defendants, Bar. Chief N.O Duru told the court that it has filed a fresh application of preliminary objection challenging the jurisdiction of the court to hear the matter.

Duru argued that intra-party cases of this nature ought not to be taken or challenged before any court of law.

He maintained that the provision of the party’s constitution requires party mechanisms for resolving internal crisis of which in this case has not been exploited.

In his response, counsel to the plaintiff, Bar. Christopher Oshomeghe who did not object the fresh application raised by the defendants counsel, however, asked the court to hear the originating summon already served on the defendants.

However, the matter could not proceed because the third defendant (APC), has not been duly served the notice.

In his ruling, Justice A. M Liman however adjourned the matter till 18th May, 2022 when all the applications will be heard.
